Die Bestellung eines besonderen Vertreters nach § 26 Abs. 1 Satz 2 können nur solche Aktionäre einer übertragenden Gesellschaft beantragen, die ihre Aktien bereits gegen Anteile des übernehmenden Rechtsträgers umgetauscht haben.
