(1) Erwägt der Staatsanwalt, die Klage zurückzunehmen, prüft er, ob die Verwaltungsbehörde vorher zu hören ist (§ 76 Absatz 3 OWiG). Nummer 275 Absatz 2, 3 gilt entsprechend.
(2) Nimmt der Staatsanwalt die Klage zurück, teilt er dies dem Betroffenen und der Verwaltungsbehörde formlos mit.
