Eines Vorverfahrens bedarf es auch, wenn ein Verwaltungsakt angefochten wird, den eine oberste Landesverkehrsbehörde oder das Bundesministerium für Verkehr und digitale Infrastruktur erlassen hat. § 28 Absatz 3a Satz 9 und § 29 Absatz 6 Satz 1 bleiben unberührt.
