Der Richter beim Amtsgericht entscheidet als Strafrichter bei Vergehen,
- 1.
- wenn sie im Wege der Privatklage verfolgt werden oder
- 2.
- wenn eine höhere Strafe als Freiheitsstrafe von zwei Jahren nicht zu erwarten ist.
