(1) Ist zu entscheiden, ob eine Partei im Hoheitsgebiet des Mitgliedstaats, dessen Gerichte angerufen sind, einen Wohnsitz hat, so wendet das Gericht sein Recht an.
(2) Hat eine Partei keinen Wohnsitz in dem Mitgliedstaat, dessen Gerichte angerufen sind, so wendet das Gericht, wenn es zu entscheiden hat, ob die Partei einen Wohnsitz in einem anderen Mitgliedstaat hat, das Recht dieses Mitgliedstaats an.
