In Unternehmen, in denen kein Wirtschaftsausschuss besteht, ist im Fall des § 106 Abs. 3 Nr. 9a der Betriebsrat entsprechend § 106 Abs. 1 und 2 zu beteiligen; § 109 gilt entsprechend.
