Zuständige Behörden für die Entscheidung über die Zulässigkeit von Vorhaben nach § 37a Abs. 1 BauGB sind abweichend von § 37a Abs. 2 Satz 1 BauGB die unteren Bauaufsichtsbehörden, soweit nicht bereits nach Art. 73 BayBO die Regierung zuständig ist.
