(1) Eine Zustellung nach Artikel 17 der Verordnung (EU) 2020/1784 durch die zuständige deutsche Auslandsvertretung soll nur im begründeten Ausnahmefall erfolgen. Eine Zustellung nach Satz 1 an einen Adressaten, der nicht deutscher Staatsangehöriger ist, ist nur zulässig, sofern der Mitgliedstaat, in dem die Zustellung erfolgen soll, dies nicht durch eine Erklärung nach Artikel 33 Absatz 1 Satz 1 der Verordnung (EU) 2020/1784 ausgeschlossen hat.
(2) Eine Zustellung nach Artikel 17 der Verordnung (EU) 2020/1784, die in der Bundesrepublik Deutschland bewirkt werden soll, ist nur zulässig, wenn der Adressat des zuzustellenden Schriftstücks Staatsangehöriger des Übermittlungsstaats ist.
