Ohne Schuld handelt, wer eine Tat nach den §§ 8 bis 15 in Ausführung eines militärischen Befehls oder einer Anordnung von vergleichbarer tatsächlicher Bindungswirkung begeht, sofern der Täter nicht erkennt, dass der Befehl oder die Anordnung rechtswidrig ist und deren Rechtswidrigkeit auch nicht offensichtlich ist.
