Das Gericht des Sitzes des Einzelkaufmanns hat die Eintragung der Ausgliederung auch dann abzulehnen, wenn offensichtlich ist, daß die Verbindlichkeiten des Einzelkaufmanns sein Vermögen übersteigen.
