Beruht der Beweis einer Tatsache auf der Wahrnehmung einer Person, so ist diese in der Hauptverhandlung zu vernehmen. Die Vernehmung darf nicht durch Verlesung des über eine frühere Vernehmung aufgenommenen Protokolls oder einer Erklärung ersetzt werden.
