(1) Stellt sich nach Eröffnung des Hauptverfahrens ein Verfahrenshindernis heraus, so kann das Gericht außerhalb der Hauptverhandlung das Verfahren durch Beschluß einstellen.
(2) Der Beschluß ist mit sofortiger Beschwerde anfechtbar.
