(1) Das für die Hauptverhandlung zuständige Gericht entscheidet darüber, ob das Hauptverfahren zu eröffnen oder das Verfahren vorläufig einzustellen ist.
(2) Die Anklageschrift enthält den Antrag, das Hauptverfahren zu eröffnen. Mit ihr werden die Akten dem Gericht vorgelegt.
