Die Behörde entscheidet nach pflichtgemäßem Ermessen, ob und wann sie ein Verwaltungsverfahren durchführt. Dies gilt nicht, wenn die Behörde auf Grund von Rechtsvorschriften
- 1.
- von Amts wegen oder auf Antrag tätig werden muss,
- 2.
- nur auf Antrag tätig werden darf und ein Antrag nicht vorliegt.
