Die Vorschriften der § 40 Abs. 4, § 46 Abs. 4 finden nur auf Soldaten auf Zeit und Berufssoldaten Anwendung, die Elternzeit nach Inkrafttreten des Vierzehnten Gesetzes zur Änderung des Soldatengesetzes vom 6. Dezember 1990 (BGBl. I S. 2588) beantragt haben.
