Bilanzrecht
Mit Freiheitsstrafe bis zu einem Jahr oder mit Geldstrafe wird bestraft, wer als Mitglied eines Aufsichtsrats nach § 7 Satz 5 oder als Mitglied eines nach § 6 Absatz 1 Satz 2 in Verbindung mit § 324 Absatz 1 Satz 1 des Handelsgesetzbuchs oder nach § 7 Satz 6 eingerichteten Prüfungsausschusses eines Unternehmens, das kapitalmarktorientiert im Sinne des § 264d des Handelsgesetzbuchs ist,
- 1.
- eine in § 20 Absatz 2a, 2b oder Absatz 2c bezeichnete Handlung begeht und dafür einen Vermögensvorteil erhält oder sich versprechen lässt oder
- 2.
- eine in § 20 Absatz 2a, 2b oder Absatz 2c bezeichnete Handlung beharrlich wiederholt.
