Die Prüfungskommission wird beim Deutschen Patent- und Markenamt gebildet. Das Deutsche Patent- und Markenamt beruft in diese Kommission Mitglieder des Bundespatentgerichts und des Deutschen Patent- und Markenamts sowie Patentanwälte und Patentassessoren.
