Für ein Unternehmen, das auf Grund der Erweiterung der Definition der Finanzinstrumente in § 1 Absatz 11 Satz 1 am 1. Juni 2012 zum Finanzdienstleistungsinstitut wird, gilt die Erlaubnis ab diesem Zeitpunkt bis zur Entscheidung der Bundesanstalt als vorläufig erteilt, wenn es bis zum 31. Dezember 2012 einen vollständigen Erlaubnisantrag nach § 32 Absatz 1 Satz 1 und 2, auch in Verbindung mit einer Rechtsverordnung nach § 24 Absatz 4, stellt.
