Ist ein Insolvenzgläubiger zur Zeit der Eröffnung des Insolvenzverfahrens kraft Gesetzes oder auf Grund einer Vereinbarung zur Aufrechnung berechtigt, so wird dieses Recht durch das Verfahren nicht berührt.
