(1) Mit Freiheitsstrafe bis zu fünf Jahren oder mit Geldstrafe wird bestraft, wer entgegen § 264 Absatz 2 Satz 3, auch in Verbindung mit § 325 Absatz 2a Satz 3, entgegen § 289 Absatz 1 Satz 5, auch in Verbindung mit § 325 Absatz 2a Satz 4, oder entgegen § 297 Absatz 2 Satz 4 oder § 315 Absatz 1 Satz 5, jeweils auch in Verbindung mit § 315e Absatz 1, eine unrichtige Versicherung abgibt.
(2) Handelt der Täter leichtfertig, so ist die Strafe Freiheitsstrafe bis zu zwei Jahren oder Geldstrafe.
