Handelsrecht
(1) Kaufmann im Sinne dieses Gesetzbuchs ist, wer ein Handelsgewerbe betreibt.
(2) Handelsgewerbe ist jeder Gewerbebetrieb, es sei denn, daß das Unternehmen nach Art oder Umfang einen in kaufmännischer Weise eingerichteten Geschäftsbetrieb nicht erfordert.
