(1) Rechtsgeschäfte, die ohne die aufgrund dieses Gesetzes erforderliche Genehmigung der Aufsichtsbehörde abgeschlossen werden, sind unwirksam.
(2) Rechtsgeschäfte, die gegen das Verbot des § 86 Abs. 5, des § 87 Abs. 1 oder des § 110 verstoßen, sind nichtig.
