Liegen die Voraussetzungen des § 82 vor, ist jedoch das Berichtigungszwangsverfahren nicht durchführbar oder bietet es keine Aussicht auf Erfolg, so kann das Grundbuchamt das Grundbuch von Amts wegen berichtigen. Das Grundbuchamt kann in diesem Fall das Nachlaßgericht um Ermittlung des Erben des Eigentümers ersuchen.
