40.1 As soon as possible after the last hearing date, or the date on which the sole arbitrator received the parties’ last authorised written submissions, the sole arbitrator shall:
(a) declare the proceedings closed with respect to the matters to be decided in the award; and
(b) inform the parties and the Institute of the date by which the sole arbitrator expects to issue the final award.
40.2 After the closing of the proceedings, no further claims, arguments or evidence may be presented with respect to the matters to be decided in the award, unless in exceptional circumstances requested or authorised by the sole arbitrator. If the sole arbitrator has set a prior cut-off date pursuant to Article 34, the prior cut-off date shall apply.
