Eine Klage auf Feststellung der Nichtverletzung kann zusammen mit einer Klage auf Nichtigerklärung des betreffenden Patents eingereicht werden. Sowohl gemäß Regel 46 als auch gemäß den Regeln 70 und 74 sind Gebühren zu entrichten.
