Verfahrensordnung des Einheitlichen Patentgerichts
Wenn klar ist, dass das Gericht für eine Klage oder bestimmte darin geltend gemachte Ansprüche nicht zuständig ist, oder wenn die Klage oder die Verteidigung dagegen ganz oder teilweise offensichtlich unzulässig ist oder offensichtlich keine rechtliche Grundlage hat, kann das Gericht eine Entscheidung per Anordnung erlassen, nachdem den Parteien rechtliches Gehör gewährt worden ist.
