Unbeschadet des Artikels 3 ist das Gericht eines Mitgliedstaats, das eine Entscheidung erlassen hat, mit der die Trennung ohne Auflösung des Ehebandes ausgesprochen wird, auch für die Umwandlung dieser Trennung ohne Auflösung des Ehebandes in eine Ehescheidung zuständig, sofern dies im Recht dieses Mitgliedstaats vorgesehen ist.
