(1)
Kann weder der gewöhnliche Aufenthalt eines Kindes festgestellt noch die Zuständigkeit gemäß Artikel 10 bestimmt werden, sind die Gerichte des Mitgliedstaats zuständig, in dem sich das Kind befindet.
(2)
Die Zuständigkeit nach Absatz 1 gilt auch für Kinder, die Flüchtlinge oder aufgrund von Unruhen in dem Mitgliedstaat ihres gewöhnlichen Aufenthalts ihres Landes Vertriebene sind.
