Für Fälle, in denen ein Emittent die Einbeziehung von Wertpapieren zum Handel an einem KMU-Wachstumsmarkt bis einschließlich zum 9. Januar 2030 kündigt, gilt § 31 des Wertpapiererwerbs- und Übernahmegesetzes mit der Maßgabe, dass § 5 Absatz 3 der WpÜG-Angebotsverordnung keine Anwendung findet. Auf Fälle, in denen die Kündigung nach dem 9. Januar 2030 erfolgt, findet § 5 Absatz 3 der WpÜG-Angebotsverordnung Anwendung.
