(1) Jeder Miterbe kann jederzeit die Auseinandersetzung verlangen, soweit sich nicht aus den §§ 2043 bis 2045 ein anderes ergibt.
(2) Die Vorschriften des § 749 Abs. 2, 3 und der §§ 750 bis 758 finden Anwendung.
