Soweit nach den §§ 674, 729 die erloschene Vollmacht eines Beauftragten oder eines geschäftsführenden Gesellschafters als fortbestehend gilt, wirkt sie nicht zugunsten eines Dritten, der bei der Vornahme eines Rechtsgeschäfts das Erlöschen kennt oder kennen muss.
