BGB AT
(1) Wird ein anfechtbares Rechtsgeschäft angefochten, so ist es als von Anfang an nichtig anzusehen.
(2) Wer die Anfechtbarkeit kannte oder kennen musste, wird, wenn die Anfechtung erfolgt, so behandelt, wie wenn er die Nichtigkeit des Rechtsgeschäfts gekannt hätte oder hätte kennen müssen.
