1Sachlich zuständig ist die untere Abgrabungsbehörde, soweit nichts anderes bestimmt ist. 2Für Anlagen nach Art. 1 ist unter den Voraussetzungen des Art. 73 Abs. 1 Satz 1 der Bayerischen Bauordnung (BayBO) die höhere Abgrabungsbehörde sachlich zuständig.
