§ 1 findet auch Anwendung, wenn die Länder Berlin und Hamburg selbst abgabepflichtig sind. § 9 Abs. 2 Satz 1 und 2 gilt für die Länder Berlin und Hamburg mit der Maßgabe, dass sie sich auch selbst als abgabepflichtig bestimmen können.
