10.1 In addition to the provisions of Articles 6.3(h) and 8.2(f), the Institute may on its own motion request that the parties comment on whether the Arbitration Rules might be more appropriate for the conduct of the arbitration than the Rules.
10.2 Where the parties agree on the application of the Arbitration Rules, the arbitration may be referred to be conducted under the Arbitration Rules prior to the confirmation of the sole arbitrator.
10.3 By agreeing to refer the arbitration to be conducted under the Arbitration Rules, the parties agree that the Arbitration Rules shall take precedence over any contrary terms of the arbitration agreement.
